These Terms & Conditions (“Terms”) govern your use of LankaAutoWeb.com (the “Site”), including browsing, creating an account, posting listings, registering a business, buying memberships or promotions, and contacting other users.

By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. Who we are

LankaAutoWeb.com is an online marketplace that helps people in Sri Lanka advertise and discover vehicles, spare parts and automotive services. We are a platform. We are not the seller, dealer, workshop or broker unless we say so in writing on a specific listing.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract under Sri Lankan law. If you use the Site on behalf of a business, you confirm you are authorised to bind that business.

3. Accounts

• You must provide accurate registration details and keep them up to date.
• You are responsible for activity under your account and for keeping your password confidential.
• You may register as an individual or as a business, subject to the options we offer.
• We may require email or mobile verification. Google sign-in, where enabled, is subject to Google’s terms as well as these Terms.
• We may suspend or close an account if we reasonably believe these Terms have been broken, the account is used for fraud or abuse, or we are required to do so by law.

4. Listings and content

When you post an ad, business profile, review, comment, photo or other content, you confirm that:

• you are the owner or are authorised to advertise the vehicle, part or service;
• the information is true, not misleading, and kept reasonably up to date;
• photos are of the actual item or premises and you have the right to use them;
• the listing does not infringe anyone else’s rights, and is not illegal, defamatory, discriminatory or pornographic;
• you will not post stolen goods, cloned vehicles, counterfeit parts, or content that assists crime.

We may edit, refuse, hide, watermark, expire or remove listings. We may apply a watermark to images. Featured, top, hot-deal or similar labels are paid promotions, not an inspection or endorsement.

You grant us a non-exclusive, worldwide licence to host, display, crop, watermark and distribute your listing content on the Site and in our marketing of the Site, for as long as the listing is live and for a reasonable period afterwards (for example backups and caches).

5. Marketplace disclaimer

The Site is a classified advertising platform. We do not:

• own, inspect, test or guarantee any vehicle, part or service advertised;
• verify ownership, encumbrances, import status, mileage, accident history or fitness for purpose;
• act as your agent in a sale, purchase, hire or repair, unless a separate written contract says so;
• guarantee that a buyer or seller will complete a transaction, or that contact details on an ad are still correct.

You must do your own checks (including viewing the vehicle, checking documents, and taking independent advice) before you pay money or transfer ownership. Arrangements, payments and disputes between users are between those users.

6. Prohibited use

You must not:

• scrape, harvest or bulk-copy listings or user data;
• post duplicate ads, fake prices, or ads in the wrong category;
• use another person’s identity, photos or contact details;
• interfere with the Site, introduce malware, or bypass security or usage limits;
• use the Site to spam, phish, or send unsolicited marketing to other users;
• circumvent membership, ad-limit or payment rules.

Other users may report listings. We may investigate and take action, including removal and account suspension. Reporting does not create a duty on us to take any particular step.

7. Memberships, promotions and payments

Paid memberships, featured ads, top ads and similar promotions are sold according to the package details shown at checkout. Prices are in Sri Lankan Rupees unless stated otherwise.

• Online card payments may be processed by PayHere. You also agree to PayHere’s terms when you use that method.
• Bank-slip payments are reviewed by us. Access or promotion may stay pending until we confirm the slip.
• Fees are generally non-refundable once a membership or promotion is activated, except where Sri Lankan law requires a refund or we cancel a purchase because we cannot deliver it.
• We may change package prices or benefits for future purchases. Changes do not alter a package already paid for, except as those package terms allow.

8. Other users and third-party services

The Site may include Google Maps, Google sign-in, reCAPTCHA, analytics, advertising pixels, sharing tools, SMS delivery and payment gateways. Those services are provided by third parties under their own terms. We are not responsible for their availability or their handling of data beyond what our Privacy Policy describes.

Links to workshops, brokers, lenders or other websites are for convenience. We do not endorse those third parties.

9. Cookies

We use strictly necessary cookies to run the Site. Optional analytics and marketing cookies are used only if you accept them. You can change that choice at any time through Cookie settings. Details are in our Privacy Policy.

10. Intellectual property

The Site design, logos, software and our own content are owned by us or our licensors. You may not copy the Site or our branding except as needed to use the services we provide to you. Listing content remains the poster’s responsibility; we may still remove it if it appears to infringe rights or these Terms.

11. Liability

The Site is provided “as is”. To the fullest extent permitted by Sri Lankan law:

• we do not warrant that the Site will be uninterrupted, error-free, or that listings are accurate;
• we are not liable for deals made between users, or for loss of profit, data, goodwill or indirect loss;
• if we are liable to you, our total liability for a claim is limited to the amount you paid us for the relevant membership or promotion in the 3 months before the claim, or LKR 5,000 if you paid us nothing.

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for fraud or for death or personal injury caused by negligence where that rule applies.

12. Indemnity

You will indemnify us against claims, losses and costs (including reasonable legal fees) arising from your listings, your dealings with other users, or your breach of these Terms.

13. Changes and termination

We may change these Terms by posting an updated version on this page. The “Last updated” date will change. If you continue to use the Site after the change, the new Terms apply. We may stop offering all or part of the Site. You may close your account by contacting us, subject to any outstanding paid period or legal retention needs.

14. Governing law

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Courts in Sri Lanka have exclusive jurisdiction, except that we may seek injunctive relief in any forum to protect our intellectual property or the Site.
